Annual Report 2020-2021

Trusts & Estates Section
Carter R. Brothers, Chair

The Trusts & Estates Section continues to serve the needs of Virginia lawyers by sponsoring educational programs and seminars on trusts and estates law; developing and providing to members bibliographies of materials on trusts and estates law, lists of experts, consultants, research, and standards associations; and providing a forum where section members can share research, source materials, and experiences.

The Trusts & Estates Section currently has 2,094 members. The annual budget for the past fiscal year was $ 14,824 and has a remining balance of $5,263.

In October, the Trusts and Estates Section co-sponsored the 39th Annual Trusts & Estates Seminar with Virginia CLE. Due to the pandemic, this CLE was held as a live webcast. It included important updates on federal and Virginia tax developments, cases and legislation.

The Trusts and Estates Sections published two newsletters, one in the Fall of 2020 another in the Spring of 2021. We appreciate the hard work and dedication of Kevin L. Stemple & Brooke C. Tansill as our newsletter editor and assistant editor respectfully. Our Fall edition offered advice on some last minute 2020 election protection options through the use of defined value clauses, discussed how the pandemic affected trusts and estates practice, and provided new creative ways to handle a socially distanced practice. Our Spring edition continued our “uncertainty planning” through the use of disclaimers, self-settled spendthrift trusts, and multiple-party accounts. In addition, the Section sponsored a dedicated issue in the Virginia Lawyer magazine that is mailed to all 50,000 lawyers in the Commonwealth of Virginia.

The officers of the Trusts and Estates Section for the 2021 - 22 bar year are: Trey T. Parker as Chair, Vanessa M. Stillman as Vice Chair, and Kevin L. Stemple as Secretary. I also wish to thank Dolly Shaffner at the VSB for keeping us on track during a challenging year.
