Advertising Policy

  1. This policy governs all advertising in Virginia Lawyer, other Virginia State Bar (VSB) publications, and on the (VSB) website.
  2. Consistent with this policy, the VSB reserves the right to reject at any time any advertisement submitted for publication on the VSB website, Virginia Lawyer, or VSB publications.  Questionable advertisements will be submitted to the VSB Executive Director for disposition in consultation with staff.
  3. Publication of any advertisement in Virginia Lawyer, VSB publications, or the VSB website does not constitute or imply that the VSB endorses, recommends, or warrants any position, product, or service advertised.
  4. Advertising must be consistent with the Virginia Rules of Professional Conduct; however, publication of an advertisement is not a determination that the advertisement complies with the Rules.
  5. The VSB reserves the right to require the inclusion of additional language in or the deletion of language from any advertisement to help ensure compliance with ethical requirements.
  6. The contents of an advertisement are the sole responsibility of the advertisers and advertising agencies.  Advertisers and advertising agencies shall assume liability for all content (including text, representations, and illustrations, and any material on a website to which the advertisement provides a link or reference) of advertisements published in Virginia Lawyer, other VSB publications, and on the VSB website, and also assume responsibility for any claims arising therefrom made against the VSB.  Advertisers and advertising agencies shall represent and warrant that 1) they possess all necessary rights to permit the publication of the advertisement, including but not limited to, the rights to any content on any website referenced or linked to in the advertisement; 2) the content complies with all relevant laws and regulations; and 3) the advertisement does not violate any rights of third parties.
  7. Advertisers and advertising agencies shall agree to indemnify and keep indemnified the VSB, its officers, employees, and agents, without limitation, and to hold them harmless from any and all liability, loss, damages, claims, or causes of action, including legal fees and expenses, that may be incurred by the VSB arising out of the publication of the advertiser’s material or out of any breach of the representations and warranties above.
  8. The VSB will not accept advertisements for illegal products or services or for obscene or pornographic material; advertising deemed to contain false or misleading content; or advertising the subject matter of which is deemed, in the sole discretion of the VSB, not to be appropriate for publication.
  9. A signed contract and insertion order must follow all verbal orders. Verbal space reservations are not considered firm orders.
  10. The opportunity to advertise in the Virginia Lawyer, other VSB publications, or on the VSB website is contingent upon available space, and publication is at the discretion of the VSB consistent with this policy.  A contract may be cancelled upon written notice received on or before each issue’s closing date. The rate will be adjusted to that earned by the actual number of insertions used.
