Supreme Court of Virginia Approves LEO 1878 and Amends Paragraph 13

On May 17, 2021, the Supreme Court of Virginia approved Legal Ethics Opinion 1878 to be effective immediately and amended Paragraph 13 of the Rules of Court to be effective July 16, 2021.

LEO 1878 “…examines the ethical duties of an attorney who assumes representation of a client in a contingent fee matter when predecessor counsel may have a claim against the client or a lien for legal fees earned on a quantum meruit basis against the proceeds of a recovery.”

The Court also amended Section IV, Paragraph 13 of the Rules for Integration of the Virginia State Bar, Part Six of the Rules of Court to be effective July 16, 2021. These Rules govern the procedures for disciplining, suspending, and disbarring attorneys. The changes to Paragraph 13 are intended to promote greater fairness, efficiency, consistency, and transparency in Bar proceedings.
