Heirs Property CLE: Understanding the Concept to Protect Ownership and Prevent Land Loss

Heirs property refers to land that has been passed down informally from generation-to-generation, often without written wills, which is now owned by cousins or more remote relatives, possibly of multiple generations. Heirs property creates social issues and impacts disadvantaged communities the hardest.

In 2020, Virginia adopted major provisions of the Uniform Partition of Heirs Property Act (UPHPA) to help prevent involuntary loss of family land and the associated real estate wealth of that family land through a hierarchy of rights and remedies for tenant-in-common owners in a partition action.

Virginia’s approach to the UPHPA preserves traditional elements of Virginia’s partition law (in-kind partition preference) while adopting major provisions of the UPHPA, with these new provisions integrated into Virginia’s partition statute for all cases, not just Heirs Property.

Operation Healing Forces: Serving Those Who Have Served Our Country

The Carrico Center continues its popular "Law Over Lunch" CLE series with a program that explores the legal needs of our returning Special Forces population and the ethical call for all attorneys to serve these veterans.

Special Operations Forces (SOF) work in up to 76 countries on any given day, tasked with carrying out the military's most confidential and specialized missions. Yet military service does not insulate these SOF servicemembers and veterans from legal issues on the homefront; indeed, sometimes the service exacerbates them. From housing law to estate planning, SOF members, veterans, and their families encounter unique legal challenges when attempting to balance their worlds.

Join Jim Giudice, US Marine Corps veteran and attorney with Williams Mullen, who will share how a new pro bono program, Operation Healing Forces, seeks to assist SOF servicemembers, veterans, and their families with tackling their legal issues on the homefront; further, he will discuss the special representational considerations of working with current and veteran servicemembers. He will be joined by Crista Gantz, Director of Pro Bono/Access to Legal Services at the Virginia State Bar, who will demonstrate why attorneys must heed the ethical call to provide pro bono service to our military personnel and their families.

Central Virginia Legal Aid Pro Bono Hotline Volunteer Drive and Training
Wednesday, March 31 from 12 - 2 pm

The hotline is a perfect way to help CVLAS clients with discrete legal advice in a virtual setting. This pro bono opportunity will allow you to learn something new, develop new skills, and know that your advocacy will make a difference in the lives of people in our community. Pro Bono Hotline Volunteers will sign up to handle 6-8 advice calls in 2.5 hour shifts several times per year from the comfort of your home or office.
