Highlights of the October 23 Virginia State Bar Council Meeting

At its meeting on October 23, 2020, in Hot Springs, the Virginia State Bar Council heard the following significant reports and took the following actions:

Amendments to LEO 1850
The Council approved by unanimous vote the revisions to LEO 1850 regarding the outsourcing of work to a lawyer or nonlawyer outside the direct supervision of a lawyer in the firm and the requirement for client consent and explanation of fee structures. The proposed changes will be presented to the Supreme Court of Virginia for approval.

Amendments to Rules of Professional Conduct 1.17, 1.18, and 5.5
The Council approved by unanimous vote minor edits and corrections to wording, numbering, and grammar in these Rules. The proposed changes will be presented to the Supreme Court of Virginia for approval.

Nominating Committee Report
To fill three vacancies on Council, one on the Disciplinary Board, and one on the MCLE Board, Council voted unanimously to nominate six candidates for Council vacancies, two candidates for the Disciplinary Board vacancy, and two nominees for the MCLE Board to the Supreme Court of Virginia for consideration for appointment to these positions. 

Amendment to the Diversity Conference Bylaws
The Council voted unanimously to amend the Diversity Conference bylaws regarding quorums for the transaction of business. 

Amendment to the Rules of the Supreme Court of Virginia Part 6, Section IV, Paragraph 13-6.D
The Council voted unanimously in favor of amending the Rule to allow a panel of five Disciplinary Board members, whether meeting in person or in an electronic meeting, to constitute a quorum for an agreed disposition of a disciplinary matter. The proposed change will be presented to the Supreme Court of Virginia for approval.

Amendment to Change the Audit Requirements for the Virginia State Bar Bylaws
The Council approved, with 36 yea votes and eight nay votes, amending the VSB audit requirements from yearly to once every three years. 

President-elect Candidates Spoke and Answered Questions
Stephanie Grana and David Neumeyer, candidates for the upcoming president-elect election, spoke at the Council meeting. The election begins November 2, 2020 and ends December 1, 2020.  

Marni E. Byrum Tribute to Justice Ginsburg and Presentation of Resolutions
Immediate-past President Marni E Byrum delivered a tribute to the late Justice Ruth Bader Ginsburg of the United States Supreme Court. Byrum also received resolutions honoring her work and the work of her firm, McQuade Byrum PLLC, during her presidential year. The resolutions would traditionally have been given at the 2020 Annual Meeting in June, cancelled due to COVID-19.
