U.S. Senators Seek Candidates for U.S. Court of Appeals for the Fourth Circuit Vacancy

The United States Court of Appeals for the Fourth Circuit, based in Richmond, will soon have a judicial vacancy. The court is one of twelve regional appellate courts and hears appeals from the nine federal district courts in Maryland, Virginia, West Virginia, North Carolina, and South Carolina, and from federal administrative agencies. The court is authorized to have 15 active circuit judges and currently has two senior judges who also participate in the court’s work.

Senators' Process:

U.S. Senators Mark R. Warner and Timothy MKaine are accepting applications from candidates interested in pursuing a nomination to fill an upcoming judicial vacancy in the United States Court of Appeals for the Fourth Circuit. Judge Barbara Milano Keenan, of Virginia, will assume senior status effective August 31, 2021. Relevant information, including a mandatory questionnaire, may be found on Senator Warner's website here. The deadline to submit materials to the senators is March 29, 2021.


The VSB will not be involved in the evaluation process. However, candidates should still send questionnaires and materials to the other bar groups:

Asian Pacific American Bar Association of Virginia
Hispanic Bar Association
Old Dominion Bar Association
Virginia Association of Criminal Defense Lawyers
Virginia Women Attorneys Association 

The following bar groups will evaluate candidates and make recommendations, but will not conduct interviews:
Virginia Association of Defense Attorneys
Virginia Bar Association
Virginia Trial Lawyers Association
