VSB Moving to Protect Clients of Ann Marie Miller of Roanoke

The Virginia State Bar has obtained a temporary injunction against attorney Ann Marie Miller and has filed for the appointment of a receiver to take over the assets and administration of her law practice.

On September 18, 2009, the Virginia State Bar appeared in the Circuit Court of the City of Roanoke and obtained a temporary injunction against attorney Ann Marie Miller. The injunction freezes her bank accounts and requires the production of her account documents for inspection by the Virginia State Bar.

Additionally, the bar has filed a petition with the circuit court to close her practice and appoint a receiver to take over the administrative affairs of the law practice. The receiver, if appointed, will assemble and turn over client files as directed by clients. The receiver will not be representing individual clients of the firm. Once the receiver is appointed, the bar will post his or her contact information. Additionally, the receiver will contact each client concerning the disposition of the client’s file.

Thereafter, the receiver will review the firm’s accounts and seek court approval to issue refunds of unearned fees and costs paid by clients, to the extent funds are still available.

On September 23, 2009, the U.S. Bankruptcy Court for the Western District of Virginia, Roanoke Division, ordered that Ms. Miller not file any new cases with the court and not accept payment for any cases not already filed.

On September 29, 2009, the bankruptcy court entered an order providing for a “standstill” on all cases where debtors are represented by Ms. Miller.
