The Supreme Court of Virginia Orders Delay of Criminal Discovery Reforms

On January 29, 2019, the Supreme Court of Virginia entered an order delaying the adoption of the new criminal discovery rules initially slated to take effect on July 1, 2019.

The changes, which amended Rules 3A:11 and 3A:12 of the Rules of the Supreme Court of Virginia will now take effect on July 1, 2020, in order to allow the different branches of the government sufficient time to comply. The delay was requested by the chairs of the Senate Finance Committee and the House Appropriations Committee.

The Court’s order, and the letter explaining the delay written by Chief Justice Donald W. Lemons may be found here.
