Kuchinsky
appealed

three-judge
circuit
court,
which
affirmed.
Mr.
Kuchinsky
then
appealed
to the
Supreme
Court of
Virginia,
which
found
that the
circuit
court
erred in
finding
against
Mr.
Kuchinsky
for
violating
rule
3.4,
fairness
to
opposing
party
and
counsel,
but
affirmed
violations
of rules
governing
conflict
of
interest
and
prohibited
transactions,
and
misconduct.
The
Supreme
Court
remanded
the case
back to
the
circuit
court,
which
again
imposed
a public
reprimand.
Mr.
Kuchinsky
again
appealed
to the
Supreme
Court,
arguing
that the
circuit
court
lacked
jurisdiction
to
impose a
sanction.
The
Supreme
Court
affirmed
the
sanction.
