Confidences and Secrets—Honoring a Subpoena Duces Tecum.

It is not improper for an attorney to produce documents pursuant to a court subpoena issued in a pending criminal prosecution notwithstanding that the documents were developed by the attorney in the course of previous representation of his current client. [DR:4-101(C)(2)]
