Update 2/28/22: At its meeting on February 26, 2022, Council unanimously approved proposed amendments to rules governing administration of the Clients’ Protection Fund.
The Virginia State Bar Clients’ Protection Fund Board (the CPF Board) seeks comments on proposed amendments to the Clients’ Protection Fund Rules. The purpose of the amendments is to correct drafting errors in the current language of several sections of the rules regarding the jurisdiction of the CPF Board to decide claims regarding attorneys who change their membership class to “Retired” or “Disabled.”
The proposed revisions contain identical language in three sections of the Clients’ Protection Fund Rules: Preamble, Section 4.B.1 (Eligible Claims) and Rules of Procedure, Sections II.E.1.a. (Reimbursable Losses) and V.F.10.a. (Processing Petitions).
The amendments will be presented to the Virginia State Bar Executive Committee and Bar Council on February 25 and 26, 2022.
The proposed changes are noted below with deletions denoted by strikethrough and additions with underlining.
has been disbarred or suspended from the practice of law, or transferred to another class of membership, pursuant to any provision of Paragraph 13 of Part 6, Section IV of the Rules of the Supreme Court of Virginia or has transferred to a class of membership and affirmed that the member will not seek a further transfer to any other class of membership under Paragraph 3 of Part 6, Section IV of the Rules of the Supreme Court of Virginia.
Inspection and Comment
Any individual, business, or other entity may file written comments in support of or in opposition to the proposed changes with Vivian R. Byrd, Clients’ Protection Fund Administrator, or the executive director of the Virginia State Bar, not later than January 31, 2022.
