Proposed Amendment to Part 6, Section IV, Paragraph 13, Revision to Definition of “Terms”
Revision to Definition of “Terms”On May 29, 2009, the Supreme Court of Virginia approved an amendment which revises the definition of “Terms.” This change would conform the definition with a proposed change to Paragraph 13 now pending before the Supreme Court which would allow the imposition of Terms with certain Suspensions. The new amendment also would strike from the definition of “Terms” language which refers to a former sanction (dismissal with terms) which no longer is authorized in Paragraph 13. (Effective August 1, 2009.)

13. PROCEDURE FOR DISCIPLINING, SUSPENDING, AND DISBARRING ATTORNEYS.
A. Definitions

“Terms” shall mean those conditions imposed on the Respondent by a Subcommittee, District Committee, Board or Circuit Court, that require the Respondent to perform certain remedial actions as a necessary condition for the Dismissal of a Complaint or Charge of Misconduct, or the imposition of an Admonition, or a Private or Public Reprimand., or a Suspension pursuant to this Paragraph.
