Basic Procedures for Appeal to Virginia State Bar Council from Final Determinations of the VSB Secretary-Treasurer Concerning Legal Aid Society License Revocations and Related Matters
Under §54.1-3916 and/or 15VAC5-10-10
1. Subsequent to receiving written notice of a final administrative determination and the reasons therefore made by the Secretary-Treasurer of the Virginia State Bar (VSB; “the bar??) pursuant to §54.1-3916 and/or 15VAC5-10-10, an aggrieved party directly in interest may appeal to the Council of the Virginia State Bar (“Council??) on the underlying record.
2. The written notice of appeal to Council should be addressed to the Secretary-Treasurer and sent by certified mail to the bar’s main address in Richmond within 30 days of the appellant’s receipt of the adverse determination.
3. The Secretary-Treasurer shall set the appeal on Council’s agenda at the next reasonably available regular meeting and notify appellant in writing of the date, time and location.
4. Evidence shall consist solely of the record before the Secretary-Treasurer including a transcript of any meeting or hearing if prepared by a certified court reporter. The appellant shall provide to the VSB, at least three weeks in advance of the appeal before Bar Council, the record and copies for each Council member to be distributed by the VSB to Council in support of appellant’s claims.
5. The appeal will be limited to whether the bar acted properly under the statute and regulations cited above.
6. The appellant and/or the Secretary-Treasurer or his or her designee may each make oral arguments to Council not to exceed fifteen minutes each (inclusive of rebuttal).
7. The appeal shall be decided by a majority vote of Council members present and voting.
