Highlights of the February 28, 2015, Virginia State Bar Council Meeting

At its meeting on February 28, 2015, in Richmond, the Virginia State Bar Council heard the following significant reports and took the following actions:

 

Adoption of Rule 5.8 by the Supreme Court of Virginia

The Council was informed of the adoption of Rule 5.8: Procedures for Lawyers Leaving Law Firms and Dissolution of Law Firm, effective May 1, 2015. The rule codifies a number of the suggestions from LEOs on departing lawyers’ obligations into more concrete steps to follow.

 

Approval of Amendments to the Rules

The Council unanimously approved amendments to the Rules of the Supreme Court of Virginia regarding Standards for Minimum Malpractice Coverage When Disciplinary Charges Heard by a Three-Judge Panel Result in a Finding of Criminal Conduct Involving Loss of Client Property, and Establishment of District Committees. The proposed rule changes will be presented to the Supreme Court of Virginia for its consideration.

Other proposed amendments regarding district committee members’ address of record, reciprocal discipline, reinstatement procedures, and disclosure of exculpatory evidence were either withdrawn by the Standing Committee on Lawyer Discipline or tabled for additional review.

 

Approval of Rules

The VSB Council amended and approved by a vote of 36–23 amendments to Rules 1.1 (Competence) and 1.6 (Confidentiality) of the Virginia Rules of Professional Conduct. The proposed rule changes will be presented to the Supreme Court of Virginia for its consideration.

 

Justice Kelsey Resolution

The Council unanimously approved the resolution honoring Justice Kelsey’s accession to the Supreme Court of Virginia.
