Supreme Court Adopts Rule Changes– On November 2, 2009, the Supreme Court of Virginia announced several rule changes, effective January 4, 2010, and one rejected rule change.
Judge rules FTC Red Flag Rule over-reaches – A federal judge ruled 10/30/09 the Federal Trade Commission cannot force practicing lawyers to comply with new regulations aimed at curbing identity theft. Rule became effective on 11/1/2009.
Legal Ethics pending public comment – The Standing Committee on Legal Ethics is seeking comments on LEO 1852 (Employment Limitations for Suspended/Revoked Lawyers) and LEO 1853 (Sexual Relationship with a Client). Comments due by November 30.
Proposed amendment to Rule 1.15 – The Standing Committee on Legal Ethics is proposing amendments to Rule 1.15 (Safekeeping Property) that eliminate redundancy in the rule and clarify the rule’s record keeping requirements. Comments due by November 30.
Proposed MCLE regulation changes – The MCLE Board is proposing a minimum number of hours that must be obtained through live programming. Comments due by December 30.
Comment invited on proposed Court rules – The Judicial Council of Virginia’s Advisory Committee on the Rules of Court is soliciting public comment on a Revised Draft Rule for Confidentiality of Juror Information and other proposed rules, including addressing e-filing issues. Deadline April 15, 2010.
