The Department of Forensic Science discovered case files containing evidence possibly suitable for DNA testing from the years 1973 to 1988. During its 2008 Session, the General Assembly directed the Forensic Science Board to ensure that all individuals who were convicted of crimes from these case files are notified that evidence exists and is available for testing.
In 2009, the General Assembly passed Senate Bill 1391. This bill authorizes the use of pro bono attorneys to assist the Forensic Science Board and the Virginia State Crime Commission in the notification process. In order to be qualified to assist in this endeavor, all participating attorneys must be trained in the notification procedures.
