Comments Sought on Amendments to the Rules of the Supreme Court of Virginia

The Committee on Lawyer Discipline is seeking public comment on proposed amendments to Part Six, Section IV, Paragraph 13-24 of the Rules of the Supreme Court of Virginia. The purpose of the amendments is to clarify what qualifies as another jurisdiction for reciprocal disciplinary purposes, and to clarify the Disciplinary Board’s authority to impose the same or less discipline as another jurisdiction and allow for leniency as appropriate. The amendments remove the strict default provisions of the existing rule that mandate imposition of the same discipline as another jurisdiction when a respondent fails to timely file a written response to a reciprocal disciplinary action.
