Changes Announced to Sentencing Guidelines

Please be advised that there are a few significant changes to Virginia's sentencing guidelines that will take effect for any defendant sentenced July 1, 2008 and after.  Specifically, the changes will affect the DrugOther, Drug Schedule I/II, Miscellaneous, and Weapons/Firearms worksheets.

The new worksheets are posted on the web at www.vcsc.virginia.gov.July 1, 2008 Sentencing Guidelines Changes include:

1. A new mandatory minimum factor on the Drug Worksheets that changes the incarceration recommendation.


2. A new factor for False Statement on Firearm Consent Form on the Weapons worksheet that impacts the guideline's recommendation.


3. Two additional Child Abuse and Neglect Offenses that are added to the Miscellaneous worksheet.


4. Offense and victim injury score changes on the Miscellaneous Worksheet that may alter the recommendation.

"What's New 2008" PowerPoint Presentation The Sentencing Commission will not offer a "What's New 2008" seminar this year. However, there will be a short PowerPoint presentation available on the Commission's website within the next week that highlights the 2008 changes to Virginia's sentencing guidelines. You are encouraged to contact us if you have any questions.

Probation Violation Guidelines
Please note that there will be NO CHANGES to the Sentencing Revocation Report and Probation Violation Guidelines in July.  The current 3rd edition, effective July 1, 2007, will be used for revocation sentencings through June 30, 2009.  Also, it is important to make sure that you are using the current worksheets because significant changes have occurred over the years.  Current probation violation guidelines may be accessed on the web at www.vcsc.virginia.gov.

Training Seminars
The Sentencing Commission will offer an Advanced Guidelines Topics seminar (pending 5 CLE) and a Guidelines Ethics Seminar (1 ethics CLE) beginning in July.  These two new seminars, in addition to the Introduction to Guidelines seminar (6 CLE), will be offered across thestate throughout the year. The attached brochure details the Commission's summer and fall training schedule.  Our winter and spring schedule will be released in December.

Guidelines Manuals/UpdatesState employees will be receiving manuals and updates later in June.  If you are a non-state employee and would like to order a manual or update, please complete the registration/order form included in the brochure and mail along with a check or money order made payable to the Treasurer of Virginia.  Materials will be shipped via UPS later in June.
