The Committee received one LEO request in FY 2017; it has been carried over into FY 2018.

The Committee issued three LEOs for review/approval by Council and SCV:

• LEO 1886 – Duty of partners and supervisory lawyers in a law firm when another lawyer in the firm suffers from significant impairment; approved by the SCV December 15, 2016

• LEO 1887 – Duty when a lawyer over whom no one has supervisory authority is impaired; presented to Council in June 2017; pending approval by SCV

• LEO 1884 – Conflicts arising from a lawyer-legislator’s employment with a consulting firm owned by a law firm; proposed in FY 16 and approved by the SCV September 30, 2016

 

Opinions pending consideration by the Committee include:

• Prosecutor’s duty to disclose evidence favorable to defendant

• Attorney-client matching service

• Updates to LEO 1750, Advertising compendium opinion

 

Rule revisions proposed by the Committee include:

• Amendments to Rules 7.1-7.5, approved by the SCV on April 17, 2017, effective July 1, 2017

• Amendments to Rules 1.6 and 3.3 were proposed in FY 16 and approved by the SCV on September 30, 2016, effective December 1, 2016


Other Committee actions include:

• Withdrawing 14 LEOs: 776, 821, 835, 856, 862, 926, 1003, 1290, 1348, 1380, 1543, 1600, 1689, 1743

• Submitting 8 previously-issued LEOs to the SCV for approval:1329, 1438, 1584, 1606, 1742, 1792, 1856, 1869 (approved November 2, 2016)

 

Ethics hotline calls through May 31, 2017, totaled 6874, for an average of 625 calls per month.
