Circuit Committees on the Resolution of Fee Disputes
There are currently twelve CCRFDs in Virginia. The committee would like to encourage judges and attorneys to continue to consider using this program in appropriate attorney-client fee dispute matters. Meanwhile, the committee has set a goal to eventually establish sufficient CCRFDs to provide the program throughout the Commonwealth.
The SCRFD wanted to reach out in a new way to attorneys who were not familiar with the fee dispute program. On May 16, 2012, they presented a four-hour CLE (three Ethics) at the Virginia Historical Society. James McCauley, VSB ethics counsel, and Wendy Inge, ALPS risk manager, provided the Ethics portion of the program. There were approximately 150 attorneys in attendance. Attendees indicated that the information provided was very informative and everyone seems to have enjoyed the program. A DVD of the CLE is available to bar associations for viewing with their members. If anyone is interested in obtaining a DVD, they should contact Paulette Davidson at email@example.com.
In fiscal year 2012, two-hundred seventy fee dispute packets were mailed from the VSB in response to requests. In that time period, chairs received agreements to participate from client petitioners in eighty-four instances and from attorney petitioners in thirteen instances. Agreements were returned from client respondents in two cases and from attorney respondents in forty-one cases. There were ten arbitrations and fourteen mediations. Four cases were resolved prior to mediation or arbitration. At the end of the fiscal year, there were ten mediations pending and five arbitrations pending.
