CHAIRPERSON'S MESSAGE

I want to thank those who have worked so hard to make the Section a vital and valuable resource to real estate practitioners. First, thanks to the members of the Board of Governors and the Area Representatives who devote their time to ensuring that the Section continues to offer Continuing Legal Education Seminars, produce articles for the Fee Simple, and otherwise contribute to the quality of real estate practice in Virginia. Our Vice-chair, John David Epperly, has worked very hard to put together a great Annual Real Estate Practice Seminar, and a joint CLE offering with the Local Government Section on real estate development for the Annual Meeting in Virginia Beach. Lee Hickok of Virginia CLE, Susan Pesner, Mike Barney and Howard Gordon organized an excellent Advanced Real Estate Seminar . Larry Schonberger has worked diligently as Secretary of the Section, keeping track of our Board meetings and actions, and working on the new policy for the subcommittees.

I would like to take this opportunity to encourage members of the Section to become active on a subcommittee or as an area representative. About ten years ago, the Board of Governors created subcommittees to increase participation in the Section and educate our membership better. Then-chairman Neil Kessler wrote in his chairman's message that he expected the subcommittee structure to be refined over the years.

Since their creation, various subcommittees have organized CLEs, written articles for the Fee Simple, and completed other projects. At the most recent meeting of the Board of Governors, the Board passed a new policy for the subcommittees, which is reprinted after this message. I encourage everyone in the Section who has an interest in a subcommittee to join that subcommittee, and if you have an idea for a new subcommittee, to present a proposal to the Board of Governors for creation of a new subcommittee. I have set forth a list of the subcommittees along with their chairs. If you are interested in joining a subcommittee, please contact the chair of the subcommittee or me, and you will be added as a member. If you would like to be an Area Representative, which requires attendance at Board meetings, please let me know. We are short on representation from the western part of Virginia, and especially encourage lawyers from that area, and those who are new to practice, to participate.

SUBCOMMITTEE POLICY STATEMENT
FOR THE REAL PROPERTY SECTION
OF THE VIRGINIA STATE BAR


WHEREAS, the Real Property Section (the "Section") of the Virginia State Bar maintains subcommittees (the "Subcommittees") for the benefit of its members; and

WHEREAS, the purpose of the Subcommittees is to provide information and education to its members, and potential members, on areas of interest related to real property, including, but not limited to, ethics, bankruptcy, housing, information and technology, land use, title insurance, legal forms, small firm and solo practice, membership and first day in practice; and

WHEREAS it is the desire of the Section to encourage the participation of as many members as possible in leadership activities, and to encourage action and new ideas on the part of the Subcommittees; and

WHEREAS, it is the desire of the Section to adopt a policy statement for guidance regarding the purpose, organization, operation of the Subcommittees.

NOW, THEREFORE, be it RESOLVED:

The purpose of the Section's Subcommittees shall be for the education and professional support of the Section's membership. The Membership and First Day in Practice Subcommittees shall also encourage enrollment of new members in the Section.

Each Area Representative shall be a member of a Subcommittee. Each Subcommittee chairperson shall serve for two years.

Each Subcommittee chairperson shall deliver a report at each meeting of the Section's Board of Governors on the Subcommittee's activities. Each Subcommittee shall submit at least one article a year, and periodic updates as may be appropriate, for The Fee Simple , the Section's newsletter, reporting on recent legislation, case law and legal events related to the Subcommittee's area of the law or activities. Each Subcommittee is encouraged to participate in a least one CLE Seminar annually.

Each Subcommittee shall meet at least once annually either in person or telephonically and the Chairperson shall deliver a report on the Subcommittee's meeting at the following Board of Governor's meeting.
