Recording Fees to Increase in 2002
It will cost a little more to record deeds and other instruments in the Clerk's Offices after July 1. The General Assembly fine-tuned its changes to the recording fees statute enacted during the 2001 session by amendments made during the 2002 session. The cost to record a typical deed will rise by a dollar. If accompanied by a plat larger than 8½" x 14", the legislators made it clear that the plat was an "additional" instrument and the fee increased for each page. The fee to record other instruments increased similarly.
The primary change is found in Senate Bill 153 (2002 Acts of Assembly, Chapter 832)
2. For recording and indexing in the proper book any writing and all matters therewith, or for recording and indexing anything not otherwise provided for,
fifteensixteen dollars for an instrument or document consisting of ten or fewer pages or sheets; thirty dollars for an instrument or document consisting of 11 through to 30 pages or sheets; and fifty dollars for an instrument or document consisting of 31 or more pages or sheets.This fee shall be in addition to the fee for recording a deed or other instrument recorded in conjunction with such plat sheet or sheets including the fee of one dollar set forth in subdivision A 1.Whenever any writing to be recorded includes plat or map sheets no larger than eight and one-half inches by fourteen inches, such plat or map sheets shall be counted as ordinary pages for the purpose of computing the recording fee due pursuant to this section. A fee of fifteen dollars per page or sheet shall be charged with respect to plat or map sheets larger than eight and one-half inches by fourteen inches. Only a single fee as authorized by this subdivision shall be charged for recording a certificate of satisfaction that releases the original deed of trust and any corrected or revised deeds of trust. One dollar and fifty cents of the fee collected for recording and indexing shall be designated for use in preserving the permanent records of the circuit courts. The sum collected for this purpose shall be administered by The Library of Virginia in cooperation with the circuit court clerks.

An additional fee which will not be codified was contained in a section of the budget bill entitled "§ 3-5.00 ADJUSTMENTS AND MODIFICATIONS TO TAXES AND FEES". This section increases the cost of recording a deed by $10.00. The increase went into effect May 1.
§3-5.03 ASSESS RECORDATION FEE In addition to the state recordation tax collected pursuant to §58.1-801 A, Code of Virginia, there is hereby assessed a 10 dollar fee on every deed admitted to record on or after May 1, 2002. Proceeds collected are to be deposited into the general fund of the state treasury.
