COURSE PURPOSE
The Intellectual Property Fall Weekend Seminar is designed by the Intellectual Property Law Section of the Virginia State Bar for patent,
trademark and copyright lawyers. This year's program features David E. Schmit, lead trial and appellate counsel in the landmark Hilton-Davis
case. In addition, the seminar will cover the White Paper, recent developments in trademark law, ethical issues for intellectual property lawyers,
and practical information on working with the trademark office.
Our keynote speaker, David E. Schmit, was the lead trial and appellate counsel for the successful plaintiff/appellee and respondent in the patent
infringement case of Warner Jenkinson Co., Inc. v. Hilton-Davis Chemical Co., 117 S. Ct. 1040 (1997). Mr. Schmit is a partner in the Intellectual
Property Department at Frost & Jacobs in Cincinnati, Ohio. His practice is directed to all aspects of intellectual property law, with particular
concentration in patent, trademark, copyright, trade secret, and unfair competition litigation. Over the past 20 years, Mr. Schmit has had extensive
experience in complex intellectual property litigation in federal and state courts and in arbitration tribunals. His presentation will include a detailed
discussion of the Hilton-Davis trial, the decision, and its impact on intellectual property law.
