Export Controls Developments and Ethical Dilemmas of Relevance to Business Lawyers

Business lawyers and their clients are often amazed by the extent to which constantly evolving U.S. export control laws and regulations affect companies’ business operations, including both their domestic conduct and their shipments of goods and transfers of technology to foreign entities abroad. This session will be valuable for the uninitiated as well as the seasoned export controls expert, addressing among other things: ethical challenges in the investigatory, voluntary disclosure and enforcement stages; recent developments, including a timely update on sweeping export control reforms initiated by President Obama; issue-spotting guidance for counsel to companies that employ or deal with foreign nationals, that are part of a multi-national organization whose products are resold to foreign markets, or that have other transnational interests or transactions; and a practical discussion of export controls considerations in M&A and other corporate and transactional scenarios regularly faced by Virginia business lawyers.
