Collection Agency Referring Accounts To Attorney.

In considering the procedure to be followed by a collection agency in referring accounts to an attorney, the Committee determined that UPR 3-102 and Va. Code §54.1-3904 work in tandem in that UPR 3-102 delineates the permissible activities of a non-lawyer Collection Agency while the referenced Code section sets out the penalty for violations of all the Unauthorized Practice Rules, including UPR 3-102. Thus, the Committee is of the view that non-lawyers must adhere to the requirements of the Unauthorized Practice Rule in question.
