Effective June 22, 2012, the Virginia State Bar Disciplinary Board suspended Dennis Philip Clarke’s license to practice law for ninety days with all but thirty days stayed. The board placed Mr. Clarke on probation for two years. The action was based on the suspension of Mr. Clarke’s District of Columbia license by the District of Columbia Court of Appeals.

On May 24, 2012, the Virginia State Bar Disciplinary Board summarily suspended Stephen Joseph Caputo’s license to practice law based on his disbarment by the Supreme Court of the State of New York: Appellate Division. The board ordered Mr. Caputo to appear on June 22, 2012, to show cause why the same discipline should not be imposed in Virginia

*Effective June 22, 2012, the Virginia State Bar Disciplinary Board revoked Stephen Joseph Caputo’s license to practice law. His license had been summarily suspended on May 24, 2012, based on his disbarment by the Supreme Court of the State of New York: Appellate Division.

On May 18, 2012, the Virginia State Bar Disciplinary Board suspended Robert Henry Smallenberg’s license to practice law for three years for failing to notify clients, opposing attorneys, and the court of a prior suspension and five interim suspensions.

*On July 26, 2012, Mr. Smallenberg filed an appeal with the Supreme Court of Virginia.

**On December 13, 2012, the Supreme Court of Virginia dismissed the appeal.

On May 18, 2012, the Virginia State Bar Disciplinary Board suspended George Wells Rowe’s license to practice law for thirty days for violating rules that govern unauthorized practice of law and committing a criminal or deliberately wrongful act that reflects adversely on the lawyer’s honesty, trustworthiness or fitness to practice law. The board also fined Mr. Rowe $5,000 for violating the Virginia Consumer Real Estate Settlement Protection Act, (now Real Estate Settlement Agents).

The court dismissed charges that he violated the professional rule requiring fees to be reasonable.

Effective February 23, 2012, the Virginia State Bar Disciplinary Board suspended Thomas Andrew Hawbaker’s license to practice law based on his February 9, 2011, disbarment in California. The board ordered that Mr. Hawbaker appear on March 23, 2012, to show cause why the same discipline should not be imposed in Virginia.

*On March 13, 2012, the Virginia State Bar Disciplinary Board continued the hearing until June 22, 2012.

**On June 22, 2012, the Virginia State Bar revoked Thomas Andrew Hawbaker’s license to practice law based on his February 9, 2011, disbarment in California. His Virginia license was summarily suspended on February 23, 2012.

On February 17, 2012, the Virginia State Bar Disciplinary Board suspended Jason Christopher Roper’s license to practice law for three years for violating rules governing candor toward the tribunal; fairness to opposing party or counsel; respect for rights of third persons; confidentiality of information; conflict of interest: general rule; conflict of interest: former client; declining or terminating representation; meritorious claims and contentions; communication with persons represented by counsel; bar admission and disciplinary matters; and misconduct.   The Board dismissed a third case against Mr. Roper for lack of clear and convincing evidence.

*On February 28, 2012, the Supreme Court of Virginia denied a stay of the suspension pending the appeal.

Effective January 18, 2012, a three-judge panel of the Circuit Court for the City of Williamsburg suspended Bambi F. Walters’s privilege to practice law in Virginia for two years with terms.  Ms. Walters is not licensed in Virginia but was registered as an attorney with the United States Patent and Trademark Office.   The court found that she violated Virginia professional rules that govern safekeeping property, unauthorized practice of law, multijurisdictional practice of law, communication concerning a lawyer’s services, and firm names and letterheads.  This was an agreed disposition of misconduct charges.

On January 23, 2012, the Virginia State Bar Disciplinary Board summarily suspended Erin Marie Weber’s license to practice law. Ms. Weber pled guilty and was convicted of embezzlement in the Circuit Court of Fairfax County, Virginia, on January 10, 2012. The board ordered her to appear on February 17, 2012, to show cause why her license should not be further suspended or revoked in Virginia.

*On February 10, 2012, the Virginia State Bar Disciplinary Board continued the hearing until April 27, 2012.

**On April 27, 2012, the Virginia State Bar Disciplinary Board revoked Erin Marie Weber’s license based on her January 10, 2012, guilty plea to and conviction of embezzlement in Fairfax County Circuit Court. Her license was summarily suspended on January 23, 2012.

On December 5, 2011, the Virginia State Bar Disciplinary Board suspended John Michael Coppola’s license to practice law for two years and six months for violating rules that govern responsibilities regarding nonlawyer assistants, violating or attempting to violate the rules of professional conduct, committing a criminal or deliberately wrongful act that reflects adversely on the lawyer’s honesty, trustworthiness or fitness to practice law, and engaging in conduct involving dishonesty, fraud, deceit or misrepresentation which reflects adversely on the lawyer’s fitness to practice law. His license had been summarily suspended on July 29, 2011, based on his April 29, 2011, disbarment by the Maryland Court of Appeals. This was an agreed disposition of misconduct charges.
