Affidavit Consenting to Revocation            

Ann Bridgeforth Tribbey, after being duly sworn, states as follows:            

1.         That she was licensed to practice law in the Commonwealth of Virginia on October 2, 1984, and is currently active and in good standing to practice law in the Commonwealth of Virginia;            

2.         That on or about October 24, 2002, Consolidated Bank and Trust Company reported to the bar an Attorney Trust Account Overdraft Dishonor on account number XXXX in the amount of $89,014.15;            

3.         That she is the holder of trust account number XXXX;            

4.         That on or about November 27, 2002, Consolidated Bank and Trust Company reported a second overdraft on trust account number XXXX in the amount of $15,853.08;            

5.         That while there is no evidence she misappropriated client funds, she acknowledges that the two trust account overdraft notices resulted from conduct by her that violates the Consumer Real Estate Settlement Protection Act, Va. Code Section 6.1-2.19 et seq. (ìCRESPAî), and certain regulations promulgated pursuant to CRESPA, 15 VAC 5-80-10 et seq. (ìRegulationsî);            

6.        That she acknowledges that the two trust account overdraft notices resulted from conduct by her that violates RPC 1.1, 1.3(a), and 1.15(a), (c), (e) and (f);            

7.         That on or about September 15, 2003, Consolidated Bank and Trust Company reported a third overdraft on account number XXXX in the amount of $11,774.52;            

8.         That while there is no evidence she misappropriated client funds, she acknowledges that this trust account overdraft notice resulted from her failure to deposit client funds in her trust account in a timely manner and that her conduct violates CRESPA and certain Regulations, as well as RPC 1.1, 1.3(a), 1.15(a), (c), (e) and (f);            

9.         That, rather than proceed to hearings on her violations of CRESPA and the Virginia Rules of Professional Conduct, she wishes to consent to the Revocation of her license to practice law in the Commonwealth of Virginia pursuant to Part 6, Section IV, Paragraph 13.L. of the Rules of Court;            

10.       That she is freely and voluntarily rendering her consent to the Revocation of her license to practice law in the Commonwealth of Virginia, without being subjected to any coercion or duress, and that she understands the implications of consenting to the Revocation of her license to practice law in the Commonwealth of Virginia; and            

11.       That she is surrendering her license to practice law in the Commonwealth of Virginia because if the bar prosecuted the three above-captioned matters, she could not prevail on the Charges of Misconduct and alleged CRESPA violations.            

Therefore, she consents to the revocation of her license to practice law in the Commonwealth of Virginia effective November 20, 2003, and agrees not to accept any new clients, or take on any new matters for existing clients, between the date she executes this Affidavit and November 20, 2003, when the revocation becomes effective.
