ORDER

            On the 9th day of December, 2003, came the Petitioners, Respondent George Epperson Price (ìRespondentî), by his counsel, Michael L. Rigsby, and Kathryn A. Ramey, Assistant Bar Counsel, on their Joint Motion for a Continuance of the hearing currently scheduled for December 12, 2003 before the Disciplinary Board on the Charges of Misconduct for VSB Docket Nos. 03-102-1617 and 03-102-2288.   The parties appeared before the Honorable Peter A. Dingman, presiding Board member, by telephone conference call.

            It appearing that the parties have agreed to certain terms described below, that there are exceptional circumstances, that Respondent has waived his right to a three judge panel for all cases pending as of December 9, 2003, and that a continuance is necessary to prevent injustice, it is hereby

            ORDERED that the present cases, VSB Docket No. 03-102-1617 and VSB Docket No. 03-102-2288, shall be continued and shall be presented with any other cases that may be pending as of December 9, 2003 before a panel of the Disciplinary Board, after direct certification by the Subcommittee of the Tenth District CommitteeóSection II (if necessary), on May 20-21, 2004, at the State Corporation Commission, Courtroom A, Tyler Building, 1300 East Main Street, Second Floor, Richmond, VA 23219;

            It is further ORDERED that, as Respondent has waived his right to elect a three judge panel in consideration of the Barís agreement to join his motion for continuance, Respondent shall have no right to elect a three-judge panel for the hearing of any case that may be pending as of December 9, 2003;

            It is further ORDERED that Respondentís license to practice law is summarily suspended pursuant to Part Six, Section IV, Paragraph 13.B.5.a.6 of the Rules of the Supreme Court of Virginia, as of December 9, 2003 and shall remain suspended until all cases pending as of December 9, 2003 are adjudicated;

            It is further ORDERED that Respondent shall comply with all suspension notice requirements of Part Six, Section IV, Paragraph 13.M of the Rules of the Supreme Court of Virginia;

            It is further ORDERED that, if requested by the Bar, Respondent shall submit to an Independent Medical Examination by a mental health professional of the Barís choosing;

            It is further ORDERED that Respondent shall promptly notify the Bar if he sees any mental health professional for assessment and/or treatment, and shall promptly sign releases as requested by the Bar that 1) permit any mental health professional to disclose all information regarding Respondentís case, history and prognosis to Kathryn A. Ramey, Assistant Bar Counsel; and 2) allow Kathryn A. Ramey to interview the mental health professional outside of the presence of Respondent or his counsel regarding Respondentís case, history and prognosis; and

            It is further ORDERED that a true copy of this Order be mailed, by Certified Mail, Return Receipt Requested, to the Respondent George Epperson Price, at his address of record with the Bar, P.O. Box 1097, Abingdon VA 24212 by regular mail to Michael L. Rigsby, Esq., counsel for Respondent, at Carrell, Rice & Rigsby, Forest Plaza II, Suite 309, 7275 Glen Forest Drive, Richmond, Virginia 23226, and delivered to Kathryn A. Ramey, Assistant Bar Counsel, Virginia State Bar, 707 East Main Street, Suite 1500, Richmond, Virginia 23219.
