On June 19, 2002, a hearing in this
matter was held before a duly convened Third District, Section One Committee
Panel consisting of Robert C. Clary, Jr. Esquire, Marcus D. Minton, Esquire,
Melvin E. Rosen, Lay Member, Suzanne T. Savery, Lay Member and W. Richard Hairfield,
Esquire, presiding.
Michael L. Rigsby, Esquire appeared
on behalf of the Respondent, Stanley Walter Preston. Assistant Bar Counsel Charlotte
P. Hodges appeared on behalf of the Virginia State Bar.
Whereupon, the hearing panel heard
opening statements from both parties, and the Bar introduced its evidence through
witnesses and exhibits. The Bar then rested its case and the Respondent, Stanley
Walter Preston, presented his evidence through witnesses and exhibits. The panel
then heard closing statements from both parties and retired to deliberate.
After due deliberation, the panel unanimously concluded that the Bar's evidence failed to support any of the Disciplinary Rules charged by clear and convincing evidence. Accordingly, all charges against the Respondent in this matter are dismissed, so long as Respondent agrees to provide the Virginia State Bar with an affidavit attesting that he will attend 6 hours of a CLE in Civil Procedure. Respondent agreed to provide such affidavit.
