DISABILITY SUSPENSION ORDER

On or about the 5th day of July, 2001, came the Petitioner, Peter W. Martone (the

Petitioner), by his counsel Rhetta M. Daniel, and filed a Petition for Disability Suspension. Attached to the Petition as Exhibit A was a neurologist's opinion letter indicating Petitioner's memory, judgement and cognitive abilities were significantly impaired. Also attached to the Petition as Exhibit B was an order of the Circuit Court of the City of Virginia Beach finding Petitioner lacked the capacity to care for his person or property and appointing Petitioner's spouse, Monique Martone (Petitioner's Guardian), as his guardian and conservator.
Following a review of the Petition and exhibits, Bar Counsel's office indicated to the Board in writing it had no objection to Petitioner's request for a disability suspension and saw no need for a hearing. The Board also received an affidavit from Petitioner's Guardian indicating she had reviewed and understood the Petition and requested the Board enter a Disability Suspension without any hearing.


It appearing proper to do so under the Rules of the Supreme Court of Virginia, Part 6, Section IV, Paragraph 13(F)(3)(a), it is hereby ORDERED that the license of Peter W. Martone to practice law in the Commonwealth of Virginia is SUSPENDED indefinitely. This suspension takes effect immediately on the date of entry of this Order. It is further ORDERED that Petitioner's Guardian give the notice required within the time specified to the individuals specified in the Rules of the Supreme Court of Virginia, Part 6, Section IV, Paragraph 13(K)(1).


It is further ORDERED that a true copy of this Order be mailed, by Certified Mail, Return Receipt Requested, to Monique Martone, Guardian and Conservator of Peter W. Martone, at Petitioner's last address of record, Pavillion Center, Suite 703, 2101 Parks Avenue, Virginia Beach, Virginia 23451, and also to the Guardian and Conservator's address as given to the Virginia Beach Circuit Court, 139 Pinewood Road, Virginia Beach, Virginia 23451; by regular mail to Petitioner's Counsel, Rhetta M. Daniel, Esq., at P.O. Box 5167, Richmond, Virginia 23220-0167; and by hand delivery to Assistant Bar Counsel Richard E. Slaney, at 707 E. Main Street, Suite 1500, Richmond, Virginia 23219.
