ORDER

 

 

On November 20, 2003, this matter came on for hearing before a duly convened panel of the Virginia State Bar Disciplinary Board consisting of Robert E. Eicher, Peter A. Dingman, Bruce T. Clark, V. Max Beard, lay member, and Karen A. Gould, 1st-Vice Chair. The Chair polled the panel members to determine whether any member had a personal or financial interest in this matter that might affect or reasonably be perceived to affect his or her ability to be impartial in this proceeding. Each member, including the Chair, verified that they had no conflicts.

The Respondent, Roger Cory Hinde, and his counsel, Gary R. Hershner, and the Virginia State Bar, represented by Bar Counsel, Barbara Ann Williams, appeared before the Disciplinary Board on Respondent=s Petition for Hearing on Lifting the Interim Suspension imposed on October 27, 2003.


The parties agreed that the Interim Suspension should be lifted upon the Respondent=s provision of his trust account number and testimony that he deposited check #6229 into trust account number 1850209211 at Wachovia Bank and when counsel for the Respondent files a pleading to dismiss or withdraw the Respondent=s appeal to the Supreme Court of Virginia of the determination made by the Virginia State Bar Disciplinary Board in VSB Docket Nos. 02-031-1044, 02-031-3428, 03-031-0336 and 03-031-0525.

The parties agree that the four-year suspension imposed in the above-referenced docket numbers shall become effective on December 11, 2003.

It is therefore ORDERED that the Interim Suspension shall be lifted when a copy of the pleading to dismiss or withdraw Respondent=s appeal is furnished to the Clerk of the Disciplinary System; and

It is further ORDERED that, in accordance with the Respondent=s agreement, he shall not oppose any subpoena duces tecum filed by the Virginia State Bar for any of Respondent=s trust account records and that the Respondent will continue to undertake searches for his trust account records and shall, if located, immediately make the same available to the Bar; and

It is further ORDERED that Respondent must comply with the requirements of Part 6, Section IV, Paragraph 13.M., of the Rules of the Supreme Court of Virginia. The time for compliance with the requirements runs from December 11, 2003. All issues concerning the adequacy of the notice and arrangements required by the Order shall be determined by the Board; and

It is further ORDERED that an attested copy of this Order be sent via certified mail, return receipt requested, to the Respondent at his address of record, 5002 Monument Avenue, Suite 101, Richmond, VA 23230, and a copy sent via regular mail to his counsel, Gary R. Hershner, at Seven South Adams Street, Richmond, VA 23220-5601 and a copy hand-delivered to Barbara Ann Williams, Bar Counsel, 707 East Main Street, Suite 1500, Richmond, VA 23219.
