ORDER


This day came the Virginia State Bar, by counsel, on its Notice of Noncompliance and Request for Interim Suspension pursuant to Paragraph 13 (B)(5)(b)(1), Section IV, Part Six of the Rules of the Supreme Court of Virginia (the Rules), upon due notice to the Respondent.

Receiving evidence from the Bar that the respondent, Jerry E. Dishner (Mr. Dishner), was ordered by the Disciplinary Board (the Board) on January 24, 2003 to, within sixty days, undergo a psychological exam by Dr. Evan Nelson in furtherance of an investigation of whether Mr. Dishner may be suffering from a Disability as that term is defined by the Rules; and receiving further evidence Dr. Nelson had attempted to schedule the exam without response from Mr. Dishner, as well as the filings from Mr. Dishner indicating he does not intend to undergo the exam ordered by the Board, it is hereby

ORDERED that Jerry E. Dishner's license to practice law in the Commonwealth of Virginia is SUSPENDED effective April 25, 2003. The suspension shall remain in effect until the Board determines Mr. Dishner has fully complied with the Board's January 24, 2003 order. It is further

ORDERED that pursuant to the provisions of Paragraph 13(M) of the Rules, the Respondent shall forthwith give notice by certified mail, return receipt requested, of the suspension of his license to practice law in the Commonwealth of Virginia, to all clients for whom he is currently handling matters and to all opposing attorneys and presiding judges in pending litigation. The Respondent shall also make appropriate arrangements for the disposition of matters then in his care in conformity with the wishes of his client.

The Clerk of the Disciplinary System is DIRECTED to mail a copy of this Order by certified mail, return receipt requested, to Jerry E. Dishner, at P.O. Box 536, Gate City, Virginia 24251-0536, his last address of record with the Virginia State Bar, and to Richard E. Slaney, Assistant Bar Counsel, Virginia State Bar, 707 East Main Street, Richmond, Virginia 23219.
